Pool fences

There is a homeowner in my neighborhood that has a pool with no fence around it. The home is on a corner lot and the pool is about 4 feet from the road. We walk by this pool on a daily basis to go to the park, visit friends, etc. City ordinance was changed 5 years ago to allow homeowners to have a pool cover if they did not have a fence, but the ordinance does not specify what kind of cover or consequences if the pool is left unattended w/o the cover.
